Under this Agreement, one party, NGO "UCU" (All-Ukrainian Public Organization Cynological Union of Ukraine) (hereinafter - the Registrar), on the one hand, and any person who has accepted the terms of this Public Offer Agreement, – Client, on the other hand, together referred to as - Parties, entered into this Public Offer Agreement (hereinafter - Agreement), addressed to an unlimited number of persons, which is an official public offer of the Registrar to register the Client's dog to participate in a specific exhibition organized by the Main Directorate of the KCU or one of the KCU structural units.
1.1. Contractual relations between the Client and the Registrar Buyer are formalized in the form of a public offer Agreement. Clicking on the “REGISTER” button on the Web page https://mydogex.com/ in the appropriate section means that the Client, according to current Ukrainian legislation, has accepted the terms of the public offer Agreement listed below. 1.2. The public offer Agreement is public, and its terms are the same for all Clients. 1.3. This Agreement comes into force from the moment of clicking the “REGISTER” button, whereby the Client declares their intention to register a dog, of which they are the owner, or if acting on behalf of the owner, to participate in a canine event (dog show) organized by one of the KSU subdivisions. 1.4. Canine events within the system of the All-Ukrainian Public Organization "Kennel Union of Ukraine" (hereinafter referred to as "KSU") are conducted based on clause 1.4 and clause 3.1 (paragraph 8) of the Charter of the All-Ukrainian Public Organization "Kennel Union of Ukraine". 1.5. Dog shows are public zootechnical events that stimulate breeding work and the breeding of purebred dogs, whose functional health and physical characteristics must meet the standard of a particular breed and which can perform work or various functions according to the specific characteristics of a particular breed. The purpose of the shows is to evaluate the quality of purebred dogs livestock in accordance with breed standards, promote purebred dog breeding, and the activities of the KSU. Dog shows are public zootechnical events that stimulate breeding work and the breeding of purebred dogs, whose functional health and physical characteristics must meet the standard of a particular breed and which can perform work or various functions according to the specific characteristics of a particular breed. The purpose of the shows is to evaluate the quality of purebred dogs livestock in accordance with breed standards, promote purebred dog breeding, and the activities of the KSU., 1.6. Show Rankings 1. KSU conducts the following ranks of shows in Ukraine: • Annual main international all-breed shows of CACIB rank – “Golden Gates” and “Ukraine” in April, “Sophia of Kyiv,” “Gold of the Scythians,” and “Golden Pectoral” in August, “Kyiv Rus” and “Crystal Cup of Ukraine” in December, conducted by the Main Administration of KSU in Kyiv; • International all-breed dog shows of CACIB rank; • National all-breed dog shows of CAC rank; • Ukrainian championships for specific breeds or breed groups of dogs; • Monobreed dog shows of CAC rank. 1.7. Participation in all-ranked dog shows is allowed for: - Dogs of breeds finally recognized by the Fédération Cynologique Internationale (hereinafter referred to as FCI); - Dogs of breeds temporarily recognized by FCI (not entitled to receive the CACIB certificate); - Dogs of breeds not recognized by FCI but recognized by KSU at the national level (listed in a separate section of the exhibition catalog or a separate catalog, not allowed to participate in the main ring competitions, not entitled to receive the CACIB certificate). 1.8. Dogs listed in the exhibition catalog must be registered in the Stud Book or Appendix to the Stud Book of an FCI member country or a country that is a contract partner of FCI (AKC – American Kennel Club, USA; KC – The Kennel Club, UK; CKC – Canadian Kennel Club, Canada).
2.1. The Registrar has the authority to register dogs to participate in specific canine events and guarantees on behalf of the KSU the Client's right to exhibit the registered animal in a specific event. 2.2. The Client pays a registration fee for the dog (or dogs) according to the rules of the specific canine event. 2.3. The performance of the Offer terms by the parties is not aimed at generating profit for any of the Parties. 2.4. Funds paid as registration fees can only be used by KSU structures in accordance with their charters for statutory activities.
3.1. The Parties are responsible for non-performance or improper performance of the terms of this Agreement in the manner provided by this Agreement and current Ukrainian legislation. 3.2. All disputes, disagreements, or claims arising from this Agreement or in connection with it, including those related to its performance, violation, termination, or invalidity, shall be resolved in the relevant court according to Ukrainian substantive and procedural law.
4.1. The Parties are not responsible for the non-performance of any of their obligations, except for payment obligations, if they prove that such non-performance was caused by force majeure circumstances, i.e., events or circumstances beyond the control of such Party, which occurred after the conclusion of this Agreement, which are unforeseen and unavoidable in nature.
5.1. The information provided by the Client is confidential. Only information about the dog participating in the canine event is subject to disclosure. 5.2. By clicking the "REGISTER" marker, the Client voluntarily consents to the collection and processing of their personal data and other confidential information provided during registration. The organizers of canine events may send letters, messages, and materials to the postal address specified during registration. Also, messages may be sent to the phone number provided during registration.
